Terms of Service

1. Agreement to these Terms

These Terms of Service (“Terms”) are an agreement between you and Muslamica (“gardeen”, “we”, “us”, “our”), the operator of the gardeen mobile application (the “App”) and the website at gardeen.app (the “Site”) — together, the “Service”. By creating an account, or by downloading or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

  • You must be at least 13 years old to use the Service.
  • If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf, and that any purchase is made with their permission.
  • You may not use the Service if you are barred from doing so under applicable law.

3. Your account

gardeen uses the shared Muslamica account system — you can sign in with a Muslamica account, or via Apple or Google. You agree to:

  • provide accurate information and keep it up to date;
  • keep your sign-in method secure and not share your account;
  • tell us promptly if you suspect unauthorised use of your account;
  • take responsibility for all activity that happens under your account.

You can delete your account at any time in the App (Settings → Account control → Delete account).

4. The Service

gardeen is a dhikr companion: you count remembrance of Allah, and your counts grow a virtual 3D garden, with streaks, levels, unlockable items, community features and an optional Premium tier. We are always improving the Service, so we may add, change, suspend or remove features (including features described as “coming soon”) at any time. Where a change materially reduces a paid feature you have already paid for, we will provide a fair remedy such as a replacement feature or a pro-rated refund where required by law.

5. Acceptable use

gardeen is a space built around worship. When using the Service — including your profile name, username, avatar, garden introduction and any interaction with other gardeners — you agree not to:

  • harass, bully, threaten or abuse others, or post hateful, obscene, sexually explicit or otherwise offensive content;
  • impersonate any person or organisation, or misrepresent your affiliation with them;
  • post spam, advertising, or content that infringes anyone’s rights (including copyright and privacy);
  • use bots, scripts, exploits or other automation to inflate dhikr counts, streaks, leaderboard positions or rewards;
  • attempt to gain unauthorised access to the Service, other accounts, or our systems, or to disrupt or overload them;
  • reverse engineer, decompile or copy the Service except where the law permits;
  • use the Service for any unlawful purpose.

You can report or mute a garden or user from within the App. We may remove content, restrict features, or suspend or terminate accounts that violate these Terms — with or without notice, depending on severity.

6. Your content

You keep ownership of the content you submit (such as your avatar, garden introduction and any uploaded audio). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display that content solely to operate, promote and improve the Service. You are responsible for your content and must have the rights to anything you upload — including any audio used as a garden sound. This licence ends when you delete the content or your account, except where content has been shared with others (for example, appearing in helper lists) or where retention is required by law.

7. Community features

Some information is visible to other users by design: your profile, your garden and its introduction, your leaderboard position and dhikr totals, and your appearance in helper lists of gardens you have helped. Helping other gardens may be subject to daily caps that differ between free and Premium accounts. Do not include private personal information in public fields.

8. Premium subscriptions

  • gardeen Premium is an optional subscription that unlocks additional features. It is billed either through muslamica.app (processed by Stripe) or through the App Store / Google Play, and includes the corresponding Muslamica Premium benefits.
  • Subscriptions renew automatically until cancelled. You can cancel at any time; access continues until the end of the paid period.
  • Where you subscribed through Apple or Google, billing, cancellation and refunds are handled under their terms; where you subscribed through muslamica.app, manage your subscription there.
  • We may change Premium pricing or contents; price changes apply from your next renewal and we will give you reasonable advance notice.
  • Statutory rights — including any cooling-off or refund rights under your local consumer law — are not affected by these Terms.

9. Donations

Donations are voluntary gifts that support the Service and community. They are not payments for goods or services, confer no additional entitlements beyond any recognition features we choose to offer (such as the supporter ring or donor wall), and are non-refundable except where a refund is required by law or a processing error occurred. Donations made through the Service are not represented to be tax-deductible.

10. Virtual items and progress

Gardens, trees, levels, streaks, butterflies, coins and other virtual items are part of the Service experience. They are licensed to you, not sold; they have no monetary value, cannot be exchanged for money, and cannot be sold or transferred. We may adjust game balance, levels and items to keep the experience fair and sustainable, and virtual items may be lost if your account is terminated for breach of these Terms.

11. Intellectual property

The Service — including the gardeen name and logo, the app, site, 3D assets, artwork, design and text — is owned by Muslamica or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App and Site for your personal, non-commercial use. If you send us feedback or suggestions, we may use them without obligation to you.

12. Third-party services

The Service relies on third parties such as Apple, Google, Firebase, Stripe, RevenueCat, Algolia and Amazon Web Services. Their services are governed by their own terms and privacy policies, and we are not responsible for third-party services we do not control.

13. Religious content

Translations, transliterations and short reminders in the Service are provided for encouragement and general benefit. They are prepared with care from well-known sources, but gardeen is not a scholarly authority, and nothing in the Service is a religious ruling (fatwa). For religious guidance, please consult qualified scholars. If you believe any content contains an error, we sincerely want to know — contact info@muslamica.app.

14. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, or that data (including counts and progress) will never be lost — though we work hard to sync and protect it.

15. Limitation of liability

To the fullest extent permitted by law, Muslamica will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or £50. Nothing in these Terms excludes or limits liability that cannot be excluded by law — including for fraud, or for death or personal injury caused by negligence — or affects your statutory consumer rights.

16. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from your content, your misuse of the Service, or your breach of these Terms, to the extent permitted by applicable law.

17. Suspension and termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable notice where practicable). Sections that by their nature should survive termination — including your content licence where applicable, disclaimers, limitation of liability and governing law — survive.

18. Governing law

These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction — except that if you are a consumer living elsewhere, you keep the protection of any mandatory consumer laws, and the right to bring proceedings in the courts, of your country of residence.

19. Changes to these Terms

We may update these Terms as the Service evolves. For material changes, we will give notice through the App or Site before they take effect; continued use after that date means you accept the updated Terms. If you do not accept them, stop using the Service and delete your account.

20. General

  • If any part of these Terms is found unenforceable, the rest remains in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms; we may assign them as part of a reorganisation or transfer of the Service, with your protections preserved.
  • These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
